How a Criminal Defence Lawyer in Toronto Handles Your Case

The first call and the arrest

Under section 10(b) of the Charter, you have the right to speak to a lawyer without delay once you are detained. Use it, and say nothing else to police. Aaron answers intake calls himself, at night and on weekends, so the advice you get from a police station comes from the lawyer who will actually handle your case. If police want to interview you or search your phone, or if you learn a warrant is out, call before you attend. A planned surrender with counsel arranged often avoids a night in cells. Our guide on what to say to police covers the basics.

Bail across Toronto and the GTA

If you are held for a bail hearing, the location depends on where you were charged: the Toronto Region Bail Centre at 2201 Finch Avenue West for Toronto, the Brampton courthouse for Mississauga and Brampton, or the local court in York, Durham or Halton. Aaron builds the release plan, including sureties, residence and conditions you can actually follow, before the hearing begins. See bail hearings.

Disclosure, pre-trial and Charter motions

Toronto’s adult criminal cases are heard at the Toronto Courthouse, 10 Armoury Street, with serious indictable trials at the Superior Court, 361 University Avenue. The middle of a case is where most are won. Aaron reviews the Crown’s disclosure and requests what is missing, tests the Crown’s position at a judicial pre-trial, and brings Charter applications where police overstepped. He also watches for unreasonable delay, which courts measure against ceilings of 18 months in the Ontario Court of Justice and 30 months in the Superior Court.

Resolution or trial

Outcomes range from a withdrawal, peace bond or discharge to a full trial. Aaron applies the same approach whether the charge is impaired driving in Toronto, domestic assault, drug offences or fraud. You get a straight assessment at each stage, including when an offer is worth taking and when it is not. Clients across North York, Vaughan and the rest of the GTA can usually meet by phone or video, and Aaron attends routine court dates on their behalf. Browse all practice areas. Our courthouse directory lists every venue we attend.

Aaron stayed calm when I couldn’t. He explained every step, fought hard on the disclosure, and in the end the charge was withdrawn. I cannot recommend him highly enough.
