The Short Answer

How can a domestic assault lawyer in Toronto help after an arrest?

A domestic assault lawyer in Toronto works on two fronts at once: securing release conditions you can live with, and positioning the case for a withdrawal, peace bond or acquittal. Aaron M. Spektor, called to the Ontario Bar in 1997, has defended these files for 30 years and handles every one personally. Early advice matters because what you do in the first days — especially any contact with the complainant — can create new charges.

Overview

What this practice is, and is not.

Ontario prosecutes domestic-related charges through a specialized Crown brief and under a strong no-drop policy. Once police are called, charges are laid almost without exception, bail and release conditions are imposed swiftly, and the accused is typically released only on conditions that prohibit contact with the complainant and exclude them from the home.

Aaron M. Spektor handles domestic files daily in the Ontario Court of Justice. The first priority is bail — securing release on terms that allow the accused to continue working, parenting, and living. The second is positioning the file for resolution: most domestic charges, in our experience, are appropriate candidates for withdrawal, peace bonds, or specialized diversion — but only with proper preparation and Crown engagement.

Where a file is set for trial, defence is conducted with full preparation: forensic timeline analysis, communications discovery, third-party records applications where indicated, and full cross-examination of the complainant on the contradictions that almost always exist in the disclosure. In many cases, the client must be prepared to testify at trial.

Aaron defends domestic assault charges across the Greater Toronto Area. Our Approach

How we work this practice.

  1. 1

    Secure release on workable terms.

Bail conditions imposed in domestic matters can be life-altering. Negotiating modifications at first appearance — and preparing the s. 519 review where needed — is the immediate priority.

  2. 2

    Communicate only through counsel.

Any direct contact with the complainant — even one initiated by them — can trigger a fresh breach charge. We instruct clients carefully and, where appropriate, facilitate proper channels.

  3. 3

    Position case for resolution.

Domestic Crown attorneys respond to credible defence engagement, complete disclosure review, and demonstrated client preparation. Resolution paths exist that do not require trial.

  4. 4

Defend at trial when resolution fails.

Some files require a trial — when the client is innocent, for the client's livelihood, immigration status and family-law position. We prepare those files fully.

Inside a domestic file

Domestic Assault Lawyer Toronto: Evidence, Sentencing, Family Impact

Why a recantation rarely ends the case

Toronto Police officers responding to a domestic call typically capture the complainant’s account on body-worn camera or in a videotaped statement at the station. If the complainant later changes their account, the Crown can ask the judge to admit the earlier statement for its truth under the principles in R. v. K.G.B., provided it was recorded, given under oath or caution, and shown to be reliable. That is why the defence focuses on the circumstances of the original statement — intoxication, motive, inconsistencies with the 911 audio and the physical evidence — rather than on whether the complainant still supports the charge.

How the domestic label changes sentencing

There is no separate offence of domestic assault; the charge is usually assault under section 266. But section 718.2 makes abuse of an intimate partner or family member a statutory aggravating factor on sentence, and since 2019 a prior intimate-partner violence conviction can raise the maximum on a repeat offence and reverse the onus at bail. A conviction prosecuted by indictment also triggers a mandatory weapons prohibition.

Family court, children and housing

A no-contact condition often operates like an instant parenting order. Where children were present, police may notify the Children’s Aid Society, and what you tell a caseworker can surface in the criminal file. Collect belongings only with a police escort, never on your own. Coordinating the criminal defence with family-law counsel early keeps one case from undermining the other, and a peace bond under section 810 can sometimes resolve both pressures without a conviction.

From arrest to resolution in Toronto

If police do not release you, the bail hearing is held at the Toronto Region Bail Centre, 2201 Finch Avenue West, and the case then proceeds at the Toronto Courthouse, 10 Armoury Street. Our domestic assault lawyer in Toronto page explains how disclosure, early-intervention eligibility and judicial pre-trials unfold there, and our bail hearings page covers release plans and variations. Expect the Crown to seek a no-contact condition for the life of the case; a variation can often be negotiated once counselling begins or the complainant asks, through counsel, for contact to resume.

Common Questions

Things clients ask before retaining us.

If yours is not on this list, please ask. We answer every intake inquiry personally.

The complainant wants to drop the charge. Can they?

No. In Ontario, charging decisions and prosecutorial discretion rest with the police and Crown attorney, not the complainant. The complainant's reluctance is relevant to Crown discretion but does not automatically end the matter. Skilled counsel can present that reluctance through proper channels.

Can I go home if my bail says I can't?

Not without a court-ordered variation. Returning home in breach of bail is a separate criminal offence carrying its own penalty and almost always leading to bail being revoked. We work to vary the condition promptly where appropriate.

What does Partner Assault Response (PARS) involve?

PARS is a court-connected counselling and accountability program. Successful completion frequently leads to withdrawal of the underlying charge or a peace bond resolution. Whether PARS is the right path depends on the file — we discuss this case by case.

Will this affect my immigration status?

It can — significantly. Even a conviction with no jail time can trigger inadmissibility for permanent residents and refugees. We work closely with immigration counsel when the file has those dimensions and structure resolution paths with that exposure in mind.

Will I go to jail for a first domestic assault charge (2026)?

For a first allegation without significant injury, custody is frequently avoidable. Depending on the evidence, outcomes range from a peace bond under section 810 or a PARS/early-intervention resolution to a withdrawal or an acquittal at trial. The right path is assessed only after the disclosure is reviewed — never by rushing to plead.

How much does a domestic assault lawyer cost?

Fees depend on whether the matter resolves at an early stage — through bail, a peace bond, or diversion — or proceeds to a contested trial. Aaron provides a clear, flat-fee quote after reviewing the disclosure, and the first consultation is free and confidential. Call (416) 599-1900.

Is domestic assault a separate charge from assault?

There is no separate 'domestic assault' offence in the Criminal Code — it is an assault (or related charge) prosecuted under Ontario's dedicated domestic-violence policy, which brings stricter bail conditions, a no-contact order, and a specialized Crown team.

How long does a domestic assault charge take to resolve?

It varies. Many first-time matters resolve within a few months through a peace bond, an early-intervention program, or a withdrawal; contested cases that proceed to trial take longer. Early defence work often shortens the process and improves the outcome.

Will a domestic assault charge show up on a background check in Ontario?

It depends on how the case ends. A conviction appears on a criminal record check. Under Ontario’s Police Record Checks Reform Act, a withdrawn or dismissed charge is generally not disclosed on standard police checks, although a vulnerable sector check can include non-conviction information in limited, exceptional circumstances. A discharge is purged from the national CPIC database one year after an absolute discharge, or three years after a conditional discharge.

Can I contact my partner through a friend if I have a no-contact bail condition?

No. Domestic assault release conditions almost always prohibit communication ‘directly or indirectly,’ which includes messages passed through friends, family, children or social media. Breaching a release condition is a separate criminal offence under section 145 of the Criminal Code, carrying up to two years’ imprisonment, and it can lead to your release being cancelled. If contact is genuinely needed, the proper route is a bail variation with the Crown’s consent or a bail review.

Does a domestic assault charge affect child custody in Ontario?

It can. Ontario family courts must consider family violence when deciding parenting arrangements under the Children’s Law Reform Act and the Divorce Act, and criminal bail conditions may restrict contact with your children while the charge is outstanding. Many conditions permit contact only under a family court order, so the criminal and family cases need to be coordinated. Anything sworn in a family court affidavit can surface in the criminal case, so get criminal advice first.

What makes bail harder to get on a domestic assault charge in Ontario?

Under section 515(6) of the Criminal Code, the accused — not the Crown — must justify release if the allegation involves choking, suffocating or strangling, or if there is a prior conviction for intimate-partner violence or an existing peace bond protecting a partner. In those reverse-onus cases, the accused must clearly demonstrate that the proposed release plan addresses the risks. Aaron M. Spektor builds that plan, including a suitable surety and residence, before the hearing.
