The Short Answer

When should I call a criminal lawyer in Whitby?

Call a criminal lawyer in Whitby as soon as you are charged or learn that police want to speak with you — ideally before any interview. Aaron M. Spektor, called to the Bar in 1997, defends assault, domestic and DUI charges for Whitby residents at the Durham Region Courthouse in Oshawa. Local Criminal Defence

Why retain a Whitby criminal lawyer.

Whitby sits at the heart of Durham Region, next door to Oshawa where the region’s criminal court is located. Charges laid in Whitby — from downtown, Brooklin, or a 401/412 traffic stop — are heard at the Durham Region courthouse at 150 Bond Street East, minutes away. Aaron M. Spektor appears there regularly.

For 30 years Aaron has defended the full range of Durham charges: impaired driving, assault, domestic violence, drug offences, fraud, weapons, and youth matters. Each Whitby file is handled personally from bail and first appearance through to trial.

Whitby’s proximity to the courthouse means matters can move quickly — which makes early defence work important. We take over the file, obtain Durham Regional Police disclosure, and attend court so you do not have to navigate the process alone.

For a confidential consultation about a Whitby criminal charge, contact Aaron M. Spektor or request an appointment online. We answer intake calls personally — after-hours and weekends included.

Criminal Lawyer Whitby: Durham Process, Conditions and Next Steps

Close to the court, quick to move

Whitby is home to Durham Regional Police headquarters and sits next to Oshawa, so cases here start fast. A person held for bail may be before a justice the next morning, and a released accused may have a first appearance soon after. At that first date the Crown provides initial disclosure; later dates cover the Crown pre-trial and a judicial pre-trial, where a judge reviews the issues before trial time is assigned at the Bond Street courthouse.

Domestic allegations and no-contact conditions

Domestic allegations are among the most disruptive charges a Whitby family can face. Release in these cases nearly always includes a term barring contact with the complainant and keeping away from the family home, sometimes for months. Moving out, arranging time with children and retrieving belongings must all happen within those terms. Variations are possible with Crown consent or a bail review. Our domestic assault guide explains how these conditions work. Contact through friends, relatives or social media counts as contact too.

Roads to watch: 412, 407 and Brooklin

Enforcement shows up on the 401 through Whitby, the north–south Highway 412 link and the 407 East extension, as well as on Highway 12 and Baldwin Street through Brooklin. A breath demand on these routes can lead to an Over 80 or refusal charge, plus roadside licence consequences that begin before any court date. Mandatory alcohol screening means a driver can be asked for a breath sample without any suspicion of drinking, but the officer must still have an approved device on hand and follow proper procedure; timing, device records and how the right to counsel was explained are all reviewed in disclosure. See our impaired driving defence page.

The first 48 hours and remote representation

Read your conditions twice, keep your phone free of contact with the complainant, and do not return to a residence you have been ordered to avoid — even if invited. Collect the names of witnesses while memories are fresh. If the complainant wants the charge dropped, that decision belongs to the Crown, not the complainant — but their views can be communicated properly through counsel. Aaron then takes over from North York: video consultations, written disclosure requests, appearances on routine dates where the court allows counsel to attend alone, and in-person attendance in Oshawa for bail, pre-trials and trial.
