Why act quickly on a Mississauga assault charge.
An assault charge in Mississauga can arise from a moment that lasts seconds — a pushing match outside a bar, a road-rage confrontation, or a family argument. Under section 265 of the Criminal Code, assault does not require an injury, or even physical contact: a raised fist or a threatening gesture can be enough. Aaron M. Spektor has defended assault charges across Peel Region for 30 years.
Most assault offences are ‘hybrid,’ meaning the Crown decides whether to proceed summarily or by indictment, which affects the penalty and the process. Charges laid anywhere in Mississauga — from Square One to Port Credit to a QEW incident — are prosecuted at the A. Grenville and William Davis Courthouse in Brampton, the main Peel Region criminal court, where Aaron appears daily. He defends the full range of assault charges.
Assault cases are frequently defensible, often turning on self-defence, credibility, or a Charter breach. Where you acted to protect yourself or another person, section 34 of the Criminal Code may provide a complete answer. And for a first allegation without serious injury, a resolution that avoids a criminal record — a withdrawal, a peace bond, or a discharge — is often achievable.
Most Mississauga clients retain Aaron by phone or video and never travel to the North York office; he attends Peel court on their behalf. If your matter is broader than an assault charge, see our Mississauga criminal lawyer page, or request a free consultation.
What a conviction actually costs.
Most assault offences are hybrid; the maximum penalty depends on the charge and how the Crown proceeds. A conviction of any kind leaves a permanent criminal record.
- 01
Simple assault (s. 266)
Up to two years less a day on a summary conviction. First-offender outcomes often range from a discharge or peace bond to a short probationary sentence.
- 02
Assault causing bodily harm / with a weapon (s. 267)
A more serious hybrid offence carrying a maximum of up to ten years by indictment, where hurt is more than trifling or a weapon is used or threatened.
- 03
Aggravated assault (s. 268)
The most serious form — wounding, maiming, disfiguring or endangering life — carrying a maximum of fourteen years.
- 04
A permanent criminal record
Any assault conviction creates a record that can affect employment, licensing, volunteering, immigration, and travel to the United States.
- 05
Release conditions
Pending trial you will usually be released on conditions, frequently including no contact with the complainant — breaching them is a separate offence.
Every assault case has a defence angle.
- 1
Self-defence and defence of another
Section 34 provides a complete defence where you acted reasonably to protect yourself or someone else — one of the most common and powerful defences.
- 2
Credibility and reliability
Many assault cases come down to competing accounts. Inconsistencies, motive to fabricate, and the reliability of witnesses are tested rigorously on cross-examination.
- 3
Charter motions
Improperly obtained statements, searches, and right-to-counsel breaches can lead to key evidence being excluded at trial.
- 4
No intent or accident
Assault requires an intentional application or threat of force; where the contact was accidental, an essential element is missing.
- 5
Resolution without a record
A withdrawal, a peace bond under section 810, or a diversion program can end a first-time or minor matter without a criminal conviction.
Assault Lawyer in Mississauga: Charge Levels, Self-Defence, Resolution
What turns simple assault into something more serious
Every assault starts with the definition in section 265. The charge escalates based on specific facts. Under section 267, “bodily harm” means an injury that interferes with health or comfort and is more than brief or trivial, and a “weapon” can be any object used, or threatened to be used, to cause harm. Section 268 covers wounding, maiming, disfiguring or endangering life. Disputing whether an injury really meets that threshold is often how a section 267 or 268 charge gets reduced.
Consent is not always a defence. In a fist fight, the courts have held that consent does not cover force intended to cause, and actually causing, serious bodily harm.
How self-defence works under section 34
Self-defence under section 34 asks three questions. Did you believe, on reasonable grounds, that force or a threat was being used against you or someone else? Did you act to defend against it? Was what you did reasonable in the circumstances? The Code lists factors such as proportionality, the use of weapons and the history between the people involved. Once the defence is properly raised, the Crown must disprove it beyond a reasonable doubt. Phone video, Square One or transit-station footage, and 911 records often decide it, and they must be preserved quickly.
Peace bonds and the Peel court process
Mississauga assault cases begin in case management court in Brampton, where disclosure is exchanged before any plea. For a first allegation, the Crown may agree to withdraw the charge if you enter a peace bond. That means promising to keep the peace for a set period, usually with a no-contact term. It is not a conviction. Where available, adult diversion may also be offered. If the case goes to trial, a judge in the Ontario Court of Justice usually hears it. For an indictable assault charge you may choose a judge and jury in the Superior Court of Justice, and Aaron explains which forum suits your defence. For the full range of charges and penalties, see our assault practice or the Mississauga criminal lawyer page.

What Mississauga clients ask first.
Can an assault charge be dropped if the other person doesn’t want to proceed?
The complainant cannot drop the charge — that decision belongs to the Crown. However, their wishes, a recantation, or weaknesses in the evidence can support a withdrawal, a peace bond, or a diversion resolution that leaves no criminal record.
Is a shove or a threat really an assault?
Yes. Under section 265, assault includes applying force without consent and attempting or threatening to do so with the present ability to carry it out. No injury is required, which is why so many Mississauga assault charges are laid after minor altercations.
Where will my Mississauga assault charge be heard?
At the A. Grenville and William Davis Courthouse at 7755 Hurontario Street in Brampton, the main criminal court for Peel Region. Aaron attends there daily and can take over your file the same day.
Will I go to jail for a first assault charge?
For a first allegation without significant injury, jail is frequently avoidable. Outcomes range from a withdrawal or peace bond to a discharge that leaves no criminal record. The right result depends on the evidence.
