Should I hire a DUI lawyer in Mississauga for a first offence?
Yes. A DUI lawyer in Mississauga helps you make the most time-sensitive decision in a first-offence case: whether to contest the charge or to pursue Ontario’s Reduced Suspension program, which depends on an early guilty plea. Aaron M. Spektor, an Ontario criminal lawyer for 30 years, reviews the disclosure before that window closes and represents you at the A. Grenville & William Davis Courthouse in Brampton, where every Mississauga DUI is prosecuted.

Why act quickly on a Mississauga DUI charge.
A DUI charge in Mississauga triggers an immediate 90-day licence suspension and a criminal court process in one of Ontario’s busiest regions. Aaron M. Spektor has defended impaired driving charges across Peel Region for 30 years, and the strongest defence almost always begins in the disclosure rather than the breath reading.
Charges laid anywhere in Mississauga — from a QEW or 403 traffic stop to a RIDE checkpoint near Square One — are prosecuted at the A. Grenville and William Davis Courthouse in Brampton, the main Peel Region criminal venue. Aaron appears there daily and defends the full range of impaired driving and DUI charges.
Most Mississauga clients retain Aaron by phone or video and never need to attend the North York office; he attends Peel court on their behalf. If your matter is broader than a DUI, see our Mississauga criminal lawyer page, or request a free consultation today.
What a conviction actually costs.
Ontario impaired-driving penalties (Criminal Code s. 320 and the Highway Traffic Act), current for 2026. Even a first conviction leaves a permanent criminal record.
- 01
Immediate roadside consequences
A 90-day Administrative Driver’s Licence Suspension and a 7-day vehicle impoundment apply at the roadside, before any court date.
- 02
First offence
Minimum $1,000 fine (increasing to $1,500 and $2,000 at higher BAC readings, and $2,000 for a refusal), a one-year driving prohibition, and a criminal record.
- 03
Second and subsequent offences
A second offence carries a mandatory 30 days in jail and a two-year prohibition; a third carries a minimum 120 days and a three-year-plus prohibition.
- 04
Reinstatement conditions
Mandatory Back on Track programming, ignition-interlock installation, and years of substantially higher insurance premiums.
Every DUI case has a defence angle.
- 1
Breath-instrument and technician challenges
Calibration and maintenance records, qualified-technician status, and the s. 320.31 timing sequence — defects can defeat the reading.
- 2
Charter motions
Sections 8, 9, and 10(b) applications to exclude breath and observational evidence obtained in breach of your rights.
- 3
The stop and the demand
Whether Peel Regional Police had lawful grounds for the stop and demand, and whether the approved-screening-device procedure was correct.
- 4
Resolution without a record
Negotiating a withdrawal, a reduction to careless driving, or a stay where the Crown’s case is vulnerable.
Impaired Driving Lawyer in Mississauga: Early Choices That Matter
The Reduced Suspension program and the plea clock
Ontario lets eligible first offenders shorten the time they spend completely off the road. Instead of serving the full suspension, a driver who pleads guilty early, enrols in the Back on Track remedial program and installs an ignition interlock can return to driving sooner, under interlock conditions. In general, the earlier the plea, the shorter the hard suspension. Cases involving bodily harm or death are excluded.
The catch is that the program requires a conviction. Taking it means giving up the Charter and breath-instrument defences that often lead to withdrawals. Aaron gets disclosure in hand quickly so you can make that choice knowing what the evidence looks like, not under a deadline.
What happens at 7755 Hurontario Street
Peel Regional Police charges from Mississauga, whether from the QEW, Highway 403, Hurontario or a Port Credit RIDE check, go to case management court at the Brampton courthouse. At the first appearance no plea is required. Disclosure is requested and the next date is set. Aaron files a designation so most Mississauga clients never have to make the drive. A judicial pre-trial usually follows once disclosure is complete.
When the stop followed a collision
Collision cases are investigated differently. Police may demand blood rather than breath. They may also get a warrant for samples a hospital took for medical purposes, and injuries can raise the charge to impaired operation causing bodily harm under section 320.14(2), which is far more serious. Whether those samples were taken and seized lawfully, and how they were analysed, are central defence issues.
Next steps
Meanwhile, the 90-day roadside suspension and 7-day impound run on their own schedule, separate from the court dates, so keep every notice police gave you and bring it to the consultation. If you drive for work, tell Aaron at the outset; it changes how both the plea decision and any interim driving arrangements should be weighed. Aaron explains your options on the first call.
